कानूनी बदलाव से चुनावी चंदे में पारदर्शिता लाने के प्रयासों पर प्रतिगामी प्रभाव पड़ेगा। इस बाबत केंद्र सरकार को चुनाव आयोग ने तब भी आगाह किया था जब 2017 में चुनावी बॉण्ड लाने के लिये नियमों में बदलाव किये गये थे। दरअसल, चुनाव आयोग ने एसोसिएशन फॉर डेमोक्रेटिक रिफॉर्म्स यानी एडीआर की याचिका का जवाब देते हुए सुप्रीमकोर्ट में हलफनामा दाखिल किया। वहीं केंद्र सरकार का दावा था कि इलेक्टोरल बॉण्ड चुनाव सुधार की दिशा में महत्वपूर्ण कदम है। जिसके चलते सरकार ने फाइनेंस एक्ट, आर.बी.आई एक्ट, जनप्रतिनिधित्व कानून, आयकर कानून, कंपनी एक्ट तथा विदेशी अनुदान नियंत्रण कानून में परिवर्तन किये थे। वहीं आयोग का मानना है कि इन बदलावों से चुनावी चंदे में पारदर्शिता नहीं रह जायेगी। अब राजनीतिक दलों के लिये अर्जित चंदे की जानकारी देना अनिवार्य नहीं रह गया है, जिससे शेल कंपनियों के जरिये चंदा देने की प्रवृत्ति बढ़ेगी।साथ ही चिंता इस बात की भी है कि अब सरकारी, निजी तथा विदेशी कंपनियों द्वारा दिये जाने वाले चंदे पर नियंत्रण नहीं रह पायेगा। नये नियम के अनुसार चंदा देने वाले का उल्लेख नहीं होगा। बड़ी चिंता इस बात को लेकर है कि नये कानून की वजह से विदेशी स्रोतों से बेहिसाब पैसा आ सकता है। लोकतंत्र के लिये यह घातक ही होगा कि चुनाव में मोटा चंदा देने वाली विदेशी कंपनियां सरकार बनने के बाद जनता से जुड़ी नीतियों को प्रभावित कर सकती हैं। इन चिंताओं से चुनाव आयोग विधि मंत्रालय को अवगत करा चुका है। आयोग ने वर्ष 2017 में इस पर चिंता जताते हुए इस निर्णय पर पुनर्विचार का आग्रह किया था। अब यह तय करना कठिन हो जायेगा कि जनप्रतिनिधित्व कानून की धारा-29 बी का उल्लंघन हुआ है कि नहीं। दरअसल, इलेक्टोरल बॉण्ड योजना के तहत एक हजार से लेकर एक करोड़ तक के बॉण्ड उपलब्ध होंगे। दान देने वाला व्यक्ति बैंक की शाखाओं से इन्हें खरीदकर अपनी पसंद की पार्टी को दे सकता है, जिसे पार्टी पंद्रह दिन के भीतर पार्टी के खाते में कैश करा सकती है। इन बॉण्डों को बड़ी संख्या में कॉरपोरेट ने खरीदा है लेकिन इसमें चंदा देने वाले का नाम नहीं आता और इसमें टैक्स भी नहीं लगता। याचिका पर सुप्रीमकोर्ट दो अप्रैल को सुनवाई करेगी।
