क्या था आरक्षण का उद्देश्य और माडल ?
कानपुर।आरक्षण का उद्देश्य केन्द्र और राज्य में सरकारी नौकरियों, कल्याणकारी योजनाओं, चुनाव और शिक्षा के क्षेत्र में हर वर्ग की हिस्सेदारी सुनिश्चित करने के लिये की गयी, जिससे समाज के हर वर्ग को आगे आने का मौका मिले। इसके लिये पिछड़े वर्गों को तीन कटेगरी अन्य पिछड़े वर्ग (ओ0बी0सी0), अनुसूचित जाति (एस0सी0) एवं अनुसूचित जन जाति (एस0टी0) में चिन्हित किया गया।

भारत में मण्डल आयोग सन 1979 में तत्कालीन जनता पार्टी द्वारा स्थापित किया गया था। अन्य पिछड़ा वर्ग एक वर्ग है, जो जातियां वर्गीकृत करने के लिये भारत सरकार द्वारा प्रयुक्त एक सामूहिक शब्द है। यह अनुसूचित जतियों एवं अनुसूचित जन जातियों के साथ साथ भारत की जनसंख्या के कई सरकारी वर्गीकरण में एक है। भारतीय संविधान में ओ0बी0सी0 सामाजिक और शैक्षिक रूप से पिछड़े वर्ग के रूप में वर्णित किया जाता है और भारत सरकार उनके सामाजिक और शैक्षणिक विकास को सुनिश्चित करने के लिये है। उदाहरण के लिये ओ0बी0सी0 सार्वजनिक क्षेत्र के रोजगार और उच्च शिक्षा के क्षेत्र में 27 प्रतिशत आरक्षण के हकदार हैं। इसी तरह अनुसूचित जातियां और अनुसूचित जन जातियां क्रमशः 15 प्रतिशत एवं 7.5 प्रतिशत आरक्षण के हकदार हैं।
विश्वविद्यालय अनुदान आयोग के पत्रांक सं0 एम0 1-5/2006 (एस.सी.टी) दिनांक मार्च 05, 2018 के द्वारा उच्च शिक्षण संस्थानों में ओ0बी0सी0, एस0सी0, एस0टी0 का आरक्षण नियमों में बदलाव कर विभागवार/विषयवार कर दिया गया है।
प्रश्न यह है कि क्या उच्च शिक्षण संस्थानों में अन्य पिछड़े वर्ग (ओ0बी0सी0), अनुसूचित जाति (एस0सी0) एवं अनुसूचित जन जाति (एस0टी0) का क्रमशः 27 प्रतिशत, 15 प्रतिशत, 7.5 प्रतिशत का आरक्षण विभागावार/विषयवार करने के लिये संविधान में संशोधन किया गया है ? शायद इसका उत्तर नही में होगा। तब प्रश्न यह खड़ा होता है कि फिर यह परिवर्तन कैसे हुआ। कार्यपालिका का यह कार्य माननीय न्यायपालिका (माननीय उच्च न्यायालय इलाहाबाद) ने विश्वविद्यालय अनुदान आयोग एवं मानव संसाधन विकास मंत्रालय, भारत सरकार को उच्च शिक्षण संस्थानों में आरक्षण विभागवार/विषयवार करने के लिये अप्रैल 2017 में निर्देशित किया गया था। माननीय न्यायालय के आदेश के अनुपालन में विश्वविद्यालय अनुदान आयोग ने मार्च 05, 2018 द्वारा विभागवार/विषयवार आरक्षण करने हेतु आदेश निर्गत कर दिये हैं।
विभागवार/विषयवार आरक्षण के दुष्परिणामः
विभागवार/विषयवार आरक्षण का मतलब है कि किसी कालेज/विश्वविद्यालय के किसी भी विभाग/विषय में जब प्रोफेसर/एसोसियेट प्रोफेसर/असिस्टेंट प्रोफेसर के चार पद होगें, तब एक पद ओ0बी0सी0 को मिलेगा, जब 07 पद होगें तब एक पद एस0सी0 को और 14 पद होगें तब 01 पद एस0टी0 को मिल सकेगा। ऐसा इसलिये कि 13 या उससे कम पदों पर 13 बिन्दुओं वाला रोस्टर लागू किया जाता है। जहां तक मेरी जानकारी है कि किसी भी कालेज/ विश्वविद्यालय के किसी भी विभाग/विषय में इतने पद नही होते हैं, (किसी कालेज/विश्वविद्यालय में यह अपवाद स्वरूप हो सकता है, कि कुछ पद मिल जायें) और विभागवार/विषयवार आरक्षण से ओ0बी0सी0, एस0सी0, एस0टी0 क्रमशः 27 प्रतिशत, 15 प्रतिशत, 7.5 प्रतिशत मिलने वाला आरक्षण पूरी तरह निषप्रभावी हो जाता है। भारत की कार्यपालिका ने संविधान व्यवस्था करके वांछित तबके को क्रमश 27 प्रतिशत, 15 प्रतिशत, 7.5 प्रतिशत आरक्षण की व्यवस्था सुनिश्चित की थी लेकिन पहले क्रीमी लेयर की व्यवस्था और अब 49.5 प्रतिशत आरक्षण को विभागवार/विषयवार आरक्षण लागू कर दिया गया है| वंचित वर्ग के बच्चों के लिए यह निर्णय समझ के परे है। दूसरे शब्दों में हम यह भी कह सकते है कि अब जनरल कैटेगरी के बच्चों के लिये 100 प्रतिशत आरक्षण उच्च शिक्षण संस्थानों में कर दिया गया है।
उदाहरणः अभी हाल में ही बांदा विश्वविद्यालय बांदा में शिक्षकों के (प्रोफेसर/एसोसियेट प्रोफेसर/असिस्टेंट प्रोफेसर) 103 पद विभागवार/विषयवार आरक्षण लागू कर विज्ञापित किये गये थे, जिनमें एक विशेष वर्ग के लगभग 80 प्रतिशत लोगों का चयन हुआ है और इस तरह ओ0बी0सी0, एस0सी0 एव एस0टी0 के बच्चों का लगभग 30 प्रतिशत हिस्सा एक विशेष वर्ग के हिस्से में चला गया।
एक तरफ माननीय उच्चतम न्यायालय के आदेशानुसार 49.5 प्रतिशत आरक्षण शिक्षकों को उच्च शिक्षण संस्थानों/विश्वविद्यालयों में देना अनिवार्य है, दूसरी तरफ विश्वविद्यालय अनुदान आयोग ने मार्च 05, 2018 के द्वारा नये आदेश के तहत विभागवार/विषयवार आरक्षण कर देने से अब केन्द्र सरकार और राज्य सरकारें यह 49.5 प्रतिशत आरक्षण देना कैसे सुनिश्चित करेंगी, एक बहुत बड़ा विचारणीय विषय है।
