नई दिल्ली। वित्त मंत्री और बीजेपी के वरिष्ठ नेता अरुण जेटली + ने सबरीमाला मंदिर में महिलाओं के प्रवेश पर सुप्रीम कोर्ट के फैसले को सिलेक्टिव बताया है। उन्होंने कहा कि कोर्ट को इस तरह के फैसले के वक्त सभी धार्मिक मान्यताओं को ध्यान में रखान चाहिए। बता दें कि मासिक धर्म की उम्र सीमा वाली 10 साल की बच्चियों से लेकर 55 साल की महिलाओं के मंदिर में प्रवेश को लेकर मनाही थी। कोर्ट ने इस नियम को खारिज करते हुए महिलाओं के प्रवेश को कानूनी तौर पर वैध बना दिया है। जेटली ने विवाहेतर संबंधों और समलैंगिकता पर दिए सर्वोच्च फैसले के भी कुछ अंशों से असहमति जताई।एक कार्यक्रम में वित्त मंत्री ने कहा, अगर आप एक प्रगतिशील कदम उठाना चाहते हैं तो इसका आधार सभी धर्म से जुड़ी प्रक्रियाओं पर होना चाहिए। संविधान + के अनुच्छेद 14 और 21 का पालन सभी धर्मों को करना होगा। ऐसा नहीं हो सकता है कि आप परंपरा में चली आ रही एक प्रक्रिया को सिर्फ उसके सामाजिक दुष्प्रभावों के बारे में सोच कर छूट दें। समलैंगिकता को अपराध के दायरे से बाहर रखते हुए सुप्रीम कोर्ट ने इसे अभिव्यक्ति की आजादी से भी जोड़ा था। जेटली ने इससे असहमति जताते हुए कहा कि सेक्सुअल पसंद को अभिव्यक्ति की आजादी नहीं कह सकते हैं।वित्त मंत्री और दिग्गज वकील जेटली ने संविधान के आर्टिकल 14 को धार्मिक आधार पर देखने को लेकर चर्चा की। उन्होंने कहा, अगर धार्मिक मान्यताओं और प्रथाओं को भी आर्टिकल 14 के तहत रखा जाता है तो यह पर्सनल लॉ पर भी लागू होना चाहिए। इस आधार पर क्या यह बहु-विवाह पर लागू होगा? मौखिक तौर पर तलाक के खिलाफ भी क्या यह लागू होगा? क्या यह ऐसे धार्मिक स्थल जहां महिलाओं का प्रवेश निषेध है, वहां पर भी आर्टिकल 14 का हवाला दिया जाएगा?जेटली ने न्यायपालिका के सबरीमाला मंदिर + में प्रवेश के फैसले को साहसिक निर्णय बताए जाने पर कहा, अगर आप प्रगतिशील और साहसिक फैसले ले रहे हैं तो इसका आधार सभी के लिए एक समान होना चाहिए। गौरतलब है कि वित्त मंत्री का यह बयान केंद्र सरकार द्वारा तीन तलाक पर अध्यादेश लाने के कुछ दिन बाद आया है। राज्यसभा में विपक्षी दलों के विरोध के कारण तीन तलाक विधेयक के अटकने के बाद केंद्र ने इसपर अध्यादेश लेकर आई थी।
