मुंबई। चर्चा का बाजार गर्म है कि सरकार रईसों पर उत्तराधिकार कर लगाने जा रही है। इसमें पुरखों से विरासत में मिली संपत्ति पर टैक्स लग सकता है। मामले के जानकार सूत्रों ने बताया कि सरकार ने उत्तराधिकार कर या संपदा शुल्क लगाने को लेकर सुझाव और प्रतिक्रिया मांगी है। इस टैक्स की पक्की जानकारी तो नहीं है लेकिन दो सूत्रों ने बताया कि यह सभी पर नहीं लगेगा।
एक सूत्र ने बताया कि टैक्स की दर 5 से 10 प्रतिशत तक हो सकती है और यह कर तय नेटवर्थ पर ही लागू होगा। सूत्र ने बताया कि इस बारे में कुछ टैक्सेशन लॉयर्स और एक्सपर्ट्स की राय भी मांगी गई है। अगर इस टैक्स को हरी झंडी दिखा दी जाती है तो इसको अगले बजट में पेश किया जा सकता है।
इंडस्ट्री के जानकारों का कहना है कि बहुत से हाई नेटवर्थ इंडिविजुअल्स (एचएनआई) ऐसा टैक्स लगने की संभावनाओं को देखते हुए पहले निपटने की तैयारियों में जुट गए हैं। पीडब्ल्यूसी इंडिया के पार्टनर प्रवीन भंबानी ने कहा, हाल के दिनों में एचएनआई सर्किल में यह चर्चा चल रही थी कि सरकार अपना खजाना भरने के लिए संपदा कर यानी उत्तराधिकार कर फिर से लागू कर सकती है। इसलिए वे लोग ट्रस्ट स्ट्रक्चर पर सक्रियता से विचार कर रहे हैं और संपदा कर से निपटने की तैयारी भी फिलहाल देश में उत्तराधिकार कर नहीं है लेकिन यह 1953 से 1986 तक लागू था। कई एचएनआई उत्तराधिकार कर को लेकर पहले से ही तैयारियों में जुट गए हैं और फैमिली ट्रस्ट बनाकर अपनी संपत्ति बचाने में लग गए हैं।
अगर देश में फिर से उत्तराधिकार कर लागू किया जाता है तो फैमिली ट्रस्ट उसके दायरे से बाहर रहेंगे क्योंकि इसमें मालिकाना हक का हस्तांतरण नहीं होगा बस ट्रस्ट की शेयरहोल्डिंग में बदलाव आएगा। एक्सपर्ट्स का कहना है कि यही वजह है कि पिछले छह महीने से ट्रस्ट बनाने में दिलचस्पी दिखाने वाले एचएनआई की संख्या में खासी बढ़ोतरी हुई है। हालांकि मुमकिन है कि फैमिली ट्रस्ट कई एचएनआई परिवारों के लिए कारगर साबित नहीं हो।
एस्टेट प्लानिंग फर्म टेरेंटिया कंसल्टेंट्स के फाउंडर संदीप नार्लेकर ने कहा, फैमिली ट्रस्ट एचएनआई को उत्तराधिकार कर से बचा सकते हैं लेकिन यह फुलप्रूफ नहीं होगा। ज्यादातर फैमिली ट्रस्ट स्टैंप ड्यूटी के अतिरिक्त खर्च के चलते अचल संपत्ति ट्रांसफर नहीं करते। ऐसे में अगर उत्तराधिकार कर लागू कर दिया जाता है तो इनके हस्तांतरण पर टैक्स लगने लगेगा।
एक्सपर्ट्स का कहना है कि सरकार 5 से 10 पर्सेंट तक उत्तराधिकार कर लागू कर सकती है। इस बारे में अधिक जानकारी के लिए फाइनैंस सेक्रटरी और सेंट्रल बोर्ड ऑफ डायरेक्ट टैक्सेज को 3 अक्टूबर को ईमेल भेजा गया था लेकिन उसका जवाब खबर लिखे जाने तक नहीं मिल पाया था।
